AllofMP3 on Life Support

For a long time, pirates have taken asylum in Russia.  No, we’re not talking about some twisted Treasure Island fantasy, but instead music piracy.  With the Record Industry Association of America (RIAA) picking off Napster, Kazaa, and Limewire one-by-one, the watchdog has set its sights on Stalin’s old stomping grounds. That’s where the current king of legally questionable music dealers, AllofMP3, sits atop its (now shaky) throne. Despite recent reports that AllofMP3 is in danger of being overthrown by the RIAA, the media is now detailing litigation strategy that will allow it to remain operational until at least June, 2007.

Just a couple days ago we reported on the US government’s joint venture with the Kremlin in an attempt to take down AllofMP3 and music pirates operating outside of America’s borders.  However, representatives for Russian music site are now publicly speaking out against allegations that it is, indeed, a pirate site. Attorneys have flatly denied that AllofMP3 has broken any laws, and as a result it will not be shutting down.  In addition, AllofMP3 refuses to admit that they have even been contacted by either the Russian or U.S. governments.

Unlike the previous witch-hunts of the Record Industry Association of America AllofMP3.com does have some legal ground to stand on. It pays 15% of all profits to the Russian Organization for Multimedia and Digital Systems (ROMS), considered the country’s own version of the RIAA.

AllofMP3 is the number two music download site behind legal file sharer iTunes.

It was recently revealed that the U.S. Copyright Office has OK’d the “unlocking” of cell phones and the use of game emulators.  Although they’re very different cracks, each had been previously considered illegal.

Given this article's been dugg, I think it's fair to point out that the statement "the current king of illegal file-sharing protocols" seems to imply that AllOfMP3 is, in fact, illegal in the country in which it is based. Which, at the current time, it is not.

If allofmp3.com is shut down at some point, their customers, who enjoyed DRM-free and fair priced music, won't go to iTunes or anywhere else where they are forced to buy DRM-plagued crap. I for one would rather go back to P2P before I buy anything with DRM on it.

There's a section of the major Moscow electronics market, Gorbushkin Dvor, which is dedicated to real, physical discs of movies (~$5-7) often before they'd be out on DVD in the US (I was there in June and could have bought "Lyudie X Tri" or "X-Men Three"), CDs (~$3-5), and software. Software prices range heavily, from $5 for the cheap stuff to $12-15 for something like Adobe Creative Suite 2. Of course, you can only pay in Russian Rubles to avoid falling afoul of the law.
Basically what I'm trying to say is killing Allofmp3 is futile, partially because it is often more expensive than buying a real CD from a vendor in your local metro station (in a booth, licensed by the city), and partially because there are worse offenders.

Whether or not allofMP3 constitutes piracy is a grey area, I personally would not call it piracy. It's just using global commerce the way it meant to be used.
